Decision

To grant the licence subject to the proposed conditions.

 

 

 

 

 

Conditions

1)    That an up-to-date record of all employees at the premises shall be retained for inspection by an authorised Immigration Officer at all times that the premises are open for business.  This record shall include the name, date of commencement of employment and a photograph of the staff member and shall be in addition to other records held at the premises.

 

2)    That the licence holder and Designated Premises Supervisor as at 1 August 2017 or any other person involved in the management of the premises since 1 February 2014 until 1 October 2017, as recorded in the Home Office report of inspections on 3/2/2014, 6/1/2017 and 8/8/2017, shall not be employed or involved in the management of the premises in any capacity.

 

In making its decision the Sub-Committee considered the lack of evidence against the current licence holder and the fact that there is a new management in place with new employees with the right to work in the UK at the restaurant.

 

The Sub-Committee noted with concern the disregard to the notice period in relation to the issue of non-display of site notices.

 

The Sub-Committee strongly encourages the responsible authorities, particularly the Local Authority and the Home Office to call for an immediate review in the event of illegal immigrants being found to be employed in the future, in view of promoting the prevention of crime and disorder objective.
